Who Is a Notary Public?

A Notary Public is an appointed official who notarises or authenticates documents for use out of jurisdiction. Notarised documents are typically used to conduct business overseas, or for applications to overseas organisations.

Once the documents are verified by the Notary Public in Singapore, it is compulsory for the Notary Public to issue a Notarial Certificate, which serves as a certification to the overseas organisation(s) receiving the said documents that they have been properly authenticated and verified. The Notarial Certificate contains a QR Code which allows the receiving organisation to verify the appointment of the Notary Public and authenticity of the notarial act performed by the Notary Public.

The role of a Notary Public includes:

  • Administering oaths and affirmations,
  • witnessing the execution (i.e. signing) of documents,
  • certifying true copies of documents, and
  • verifying of identities, among others.

The Notarial Process

  1. Identity verification and understanding of documents
Before notarising a document, the Notary Public verifies the identities of all signing parties and ensures that the signing parties are aware of the contents of the document and sign the document voluntarily.
  2. Witnessing of signatures
After identity verification and confirmation of understanding, the Notary Public witnesses the signing of the document.
  3. Certification of true copies
For the certification of true copies, the Notary Public compares the original document with the copy to confirm that both are identical before certifying the copy.
  4. Notarial certificate and seal
In Singapore, it is compulsory for notarised documents to include a notarial certificate. This certificate bears the signature and stamp of the Notary Public, along with a Notarial Seal.
  5. Post-notarisation authentication and legalisation
After notarisation, it is compulsory for all notarised documents to be submitted to the Singapore Academy of Law (SAL) for further authentication and issuance of an Apostille Certificate.
  6. Embassy or consular verification (if applicable)
Certain documents may also require verification by the relevant Embassy, Consulate, or High Commission.

How Long Does Notarisation Take?

Notarisation at our Adelphi Office is typically completed within the same day but may take longer due to:

  • Document complexity
  • Number of documents
  • Whether additional verification is required

Who is a Commissioner for Oaths?

A Commissioner for Oaths is an official appointed by the Singapore Academy of Law to administer oaths for use locally. Documents like Statutory Declarations and Affidavits to be submitted to Singapore Courts would have to be signed in the presence of a Commissioner for Oaths.

At Hoh Law Corporation, Commissioner for Oaths are available at our branch offices in Adelphi, Ang Mo Kio, Jurong, and Paya Lebar. See office addresses and opening hours here.

What Should I Bring for a Notary Appointment?

To ensure a smooth notarisation process, please bring along:

  • Original documents to be notarised
  • Original valid photo identification (e.g. passport or NRIC)
  • Any supporting documents relevant to the transaction
  • Clear instructions from the overseas authority, if available
