Frequently Asked Questions

Do I need a lawyer for a Syariah divorce?

While individuals may represent themselves, Syariah Court proceedings involve procedural requirements, documentation and legal considerations that can be challenging without professional guidance. A lawyer can assist in protecting your interests and navigating the process effectively.

Do remember that the Syariah Court is an adjudicating body. The court does not provide legal advice. One should note that, as the divorce proceedings goes along or if the divorce proceedings is at an advanced stage, it could potentially get more difficult for our lawyers to assist. As such, it is better to see a lawyer at an early stage in the divorce proceedings or before you make the divorce application.

Certain ancillary matters may be dealt with by the Family Justice Courts following the Syariah Court proceedings. The applicable process depends on the circumstances of each case.

Harta Sepencarian refers to matrimonial assets acquired during the marriage which may be subject to division following divorce. The court considers various factors when determining the appropriate distribution.

Faraidh refers to the Islamic law governing the distribution of a deceased Muslim’s estate among eligible beneficiaries. Distribution depends on the family structure and applicable inheritance principles.

According to Sections 111 and 112 of the Administration of Muslim Act, all Muslims domiciled in Singapore is subject to principles of Faraidh. As the distribution laws under Faraidh are complex, it is best you consult a lawyer to get full advice on distribution of estate assets.

Where no Will/Wasiat exists, the estate will generally be distributed according to the rules of Faraidh after the appropriate probate or administration process has been completed.

By executing a Will/Wasiat, the testator may make arrangements to bequeath a part of his/her estate to non-Faraidh beneficiaries and appoint his/her choice of executor/executrix to manage and distribute the assets in his/her estate.

The preparation of a Will/Wasiat is subject to several conditions. It is best that you consult a lawyer to safeguard your interests.
