Mr. Azmi Muda, a Malaysian technician, suffered serious head injuries in a workplace accident where a metal piece flew out of a machine which he was using. Mr Azmi had sued his employer, who tried to avoid liability by claiming that Mr Azmi had signed a waiver, when representatives of his employer confronted him while Mr Azmi was still recovering in hospital. The Court held that the waiver was invalid and lacked proper consideration. The employer also submitted a false document misrepresenting Mr Azmi’s employment period.
