  • We will carefully look through the contractual terms to ensure that your interests are protected at all times.
  • We will conduct comprehensive checks on the title deed of the property to ensure that you are purchasing from the rightful owner. We will also advise you on the negotiation process and other pertinent details.
  • Government regulations change from time to time. We will ensure that you are kept up to date with the latest changes so that you are not caught off-guard by changes in regulatory framework when you are ready to purchase/sell your property.
  • We will lodge a caveat against the title to the property when you are ready to complete the purchase of your House or Flat to notify the public and/or any other interested third parties that you have a valid claim or interest in the said property.
  • Bank loans are often used to finance the purchase of property in Singapore. As your lawyers, we will also liaise with the loan party to prepare the mortgage and secure the loan successfully.
  • We will liaise with the CPF Board and/or the bank to ascertain in writing that your required loan amount and CPF amounts are ready for drawdown for the successful completion of your House or Flat within the agreed time window. This is crucial as incompliance with the completion period can lead to unintended consequences.
  • We will follow through up till Completion date, where there will be payment of the contracted sale price (from the buyer) in exchange for the signed conveyance of title to the new owner.

What Is A Lease?

The owner of the land or property can create a lease, also expressed as an interest in the land or property, by establishing a legally binding relationship between parties. This arrangement is formally established through tenancy agreements between parties.

Tenancy agreements can either be oral or written. Some tenancy agreements can also arise from the conduct between parties.

Who Are the Parties?

Under Singapore law, the owner of the land or property is known as the Landlord. The Landlord will enter into a legal agreement with the party who wants to lease the land or property from the Landlord, known as the Tenant/Lessee (in the case of HDB).

If the lease allows, or does not expressly prohibit, a Tenant may create a sub-tenancy from an existing lease. This is known as sub-letting. However, it is crucial to note that if the Tenancy Agreement expressly prohibits such an arrangement and the Tenant goes on to create sub-tenancy, the Landlord has the right to terminate the tenancy for breach of Tenancy Agreement.
